Our limitation of liability establishes clear rules for all business relationships. It ensures that risks remain transparent and understandable for both parties. We accept unlimited liability for damages, irrespective of the legal basis of the claim, in cases of wilful misconduct and gross negligence. This framework is intended to protect both our customers and our employees.
Limited Liability in Cases of Ordinary Negligence
In cases of ordinary negligence, our liability, as well as that of our legal representatives and vicarious agents, is limited. The maximum amounts are:
- Property damage: up to €1,000,000 per individual claim
- Financial loss: up to €100,000 per individual claim
This provision helps make risks more predictable while supporting efficient project implementation. Any further liability arising from mandatory statutory claims remains unaffected.
Exceptions to the Limitation of Liability
The limitation of liability does not apply to:
- Damage resulting from injury to life, limb or health
- Damage resulting from the breach of material contractual obligations
Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract in the first place. In such cases, however, liability is limited to the foreseeable damage typically associated with the contract.
What This Means for Our Customers
Our limitation of liability provides customers with a clear framework. This supports effective planning for industrial wastewater treatment projects. Risks are allocated fairly without compromising the quality of our services or the safety of our systems.
Clearly defined liability provisions protect all parties involved and support a cooperative business relationship. Customers know which liability rules apply and can calculate their project costs and risks accordingly.
